Oregon's most notorious gangster James Butler “Big Jim” Elkins. Spent the first 30 years of his life as a bootlegger and drug smuggler until he turned on the mob and testified before The U.S. Senate investigations of organized crime, of which Robert Kennedy (brother of John F. Kennedy) was a key participant. However, Elkins was convicted by a federal court, which he appeals to the United States Supreme Court claiming the evidence was seized unlawfuly from Elkins home. 

Elkins won his appeal in the landmark case Elkins v. United States, which held the "silver platter doctrine" which allowed federal prosecutors to use evidence illegally gathered by state police, to be a violation of the Fourth Amendment to the United States Constitution. 

This is an original 1958 seventy-two page document containing the entire appeal. On the cover, in pencil,  is a name and contact information for Aaron Brown, Attny. 

This document is part of a collection of items from the family of Big Jim Elkins and comes with a letter from the son of Mr. Elkins, describing his relationship to Elkins and the mysterious circumstancs surrounding the death of the former mob boss.

Elkins v. United States, 364 U.S. 206 (1960), was a US Supreme Court decision that held the "silver platter doctrine", which allowed federal prosecutors to use evidence illegally gathered by state police, to be a violation of the Fourth Amendment to the United States Constitution.

Evidence of illegal wiretapping had been seized from the home of James Butler Elkins byPortland Oregaon police officers on an unrelated search warrant, and he was subsequently convicted in federal court. Elkins appealed, arguing that evidence found by the officers should have been inadmissable under the exclusionary rule, which forbids the introduction of most evidence gathered through Fourth Amendment violations in criminal court.

In a 5-4 decision, the Court overturned the silver platter doctrine and Elkins' conviction.
